When employees post negative information about your organization on publicly accessible Internet pages, organizations are challenged as to how to maintain their reputations, counter the negative information, and not run afoul of the law. A recent jury verdict against an employer from a federal district court in New Jersey illustrates this problem.
The ADAAA is not Applied Retroactively
A case from the U.S. Court of Appeals for the Sixth Circuit explains that the recent amendments to the Americans with Disabilities Act (ADAAA) are not to be retroactively applied. In Milholland v. Sumner County Board of Education, 569 F.3d 562 (July 2, 2009), a Tennessee teacher, Sherry Milholland (Milholland), was diagnosed in 2001 with inflammatory arthritis. She performed her job and had no medical restrictions for either a teacher’s or an administrator's position.
You won’t believe this, but… you CAN curb gossip at work!

President's Message


As we now formally do business as in2vate, llc, my primary feeling is gratitude. I am thankful to so many of you who are reading this right now – members of the in2vate team, loyal clients and partners, and even those of you who may be experiencing us for the very first time.

First and foremost, let me thank those of you who have traveled with us on our journey. I usually refer to "clients and partners" (as I just did in the paragraph above) but, to me, they are almost always one and the same. In fact, a number of you – through the work we've done for and with you – have contributed a great deal to the strengths of the in2vate organization and, most importantly, to our collective ability to better the lives we touch. Especially to you (and you know who you are!), I offer my heartfelt thanks.

Part of the reason I cherish the client/partner relationship likely stems from my own initial experience with this organization, back in the late 1990s, as a client/partner, myself. Soon after, now almost 10 years ago, I formally joined the team ... and I can attest that the entire in2vate team shares this affection – a real passion – for relationships.

As a staff, we have worked hard to internally develop and externally expand our capabilities. Today, we include an unprecedented team of professionals in every discipline relevant to risk management. I am tempted to say that I'd put our team up against anybody ... but that's not how we think or operate – instead, I will say that I'd be delighted to put our team alongside anybody, working together to fulfill our mutual goals and objectives on behalf of environments, organizations and, ultimately, people.

And, working together, our emergence as in2vate means a redoubled commitment to innovation, leveraging technology as well as the impact that only human beings can make, especially when working together – or perhaps I should say "2gether"! Already, we have a wide variety of new and newly enhanced capabilities, including a highly customizable LMS, videoconferencing, webconferencing, and even our first App (for the iPhone).

But none of this matters without our core value – integrity – in all that we do. I continue to pledge – personally and on behalf of the entire in2vate team – that we will remain fully committed to this and all of our values. You deserve nothing less.

And so I will conclude the way I began – thank you! I deeply appreciate all we've accomplished together and have great excitement for what's to come ...
